Rules of the prize game: “Aircash and Mastercard take you to the biggest party this summer”

Based on Article 69 of the Law on Games of Chance (NN 87/09, 35/13, 158/13, 41/14, 143/14, 114/22) and the Regulation on Organizing Prize Games (NN 08/10), AIRCASH Ltd., OIB: 99833713101, Vukovarska Street 271, 10 000 Zagreb, Croatia, hereby issues:

RULES OF THE PRIZE GAME

“Aircash and Mastercard take you to the biggest party this summer”

These rules of the prize game have obtained the consent of the Ministry of Finance of the Republic of Croatia:

Zagreb, June 20, 2023.

Article 1.

Organizer

The organizer of the prize game titled “Aircash and Mastercard take you to the biggest party this summer” and the data controller is AIRCASH Ltd., OIB: 99833713101, with its registered address at Vukovarska Street 271, 10 000 Zagreb, Croatia (hereinafter referred to as the Organizer).

Article 2.

Duration and purpose of the prize game

The prize game titled “Aircash and Mastercard take you to the biggest party this summer” (hereinafter referred to as the Prize Game) will take place from July 1, 2023 (12:00 PM) until August 7, 2023 (10:00 AM).

The Rules of the Prize Game (hereinafter referred to as the Rules) will be published on the official website of the Organizer (www.aircash.eu), along with the mention of the class, registration number, and date of approval by the Ministry of Finance.

The purpose of the Prize Game is to promote the services and products of the Organizer.

Article 3.

Eligibility and method of participation

All adult individuals, citizens of the Republic of Croatia, have the right to participate in the Prize Game during the period specified in Article 2 of these Rules by registering to participate in the Prize Game in a manner that successfully completes at least one payment of at least 10 EUR using an Aircash Mastercard® prepaid card at one of the online or physical points of sale that accept payments with Aircash Mastercard prepaid cards.

Each separate payment made by an individual participant of the Prize Game in accordance with the conditions stated in the preceding paragraph of this article will be considered as a valid and separate entry and will be included in the drawing of the Prize Game winner.

Employees of the Organizer and members of their immediate families are not eligible to participate in the Prize Game.

Article 4.

Prize Fund

The total prize fund amounts to 5,632.48 EUR (including VAT).

The prize fund consists of 1 prize, namely the “VIP Package for ZURICH OPENAIR 2023” for two persons, which will take place from August 22nd to August 26th, 2023, in Zurich, with a value of 5,632.48 EUR (including VAT). The package includes:

• Two festival VIP passes for all five (5) days of the festival, including access to a separate main entrance, a platform with the best view of the main stage, separate toilets and dedicated bars, shorter waiting times, and an enhanced festival experience.
• Accommodation in proximity (within walking distance to ZOA) for four (4) nights with breakfast from August 22nd to August 26th, 2023.
• Airport transfer to and from the accommodation.
• Round-trip air tickets and travel health insurance for two (2) persons.
• A pocket money voucher worth 500.00 EUR.

The prize cannot be exchanged for cash. Participants in the Prize Game do not have the right to request different prizes than those listed in these Rules.

Article 5.

Prize Drawing

The prize drawing will take place on August 8th, 2023, at the headquarters of the Organizer, located at Vukovarska Street 271, 10000 Zagreb, Croatia, at 2:00 PM.

The winner of the prize game will be determined through a random selection process using a computer program employed by the Organizer.

The fairness of the prize drawing will be overseen by a three-member commission chosen by the Organizer. A record of the drawing process will be kept.

The names of the prize winners will be published on the official website of the Organizer (www.aircash.eu), and the Organizer will send a written notification of the prize to the winners within five days from the date of the prize drawing, either via email to the participant’s registered email address or through postal or courier services.

In the event that the number of participants in the prize game is lower than the number of prizes allocated in the prize fund, the provision of Article 7 of these Rules will apply.

Article 6.

Prize Collection

The condition for receiving the prize is that participants agree to the rules and fulfill the conditions for participating in the prize game.

The prize can only be redeemed during the festival period, from August 22nd to August 26th, 2023, in Zurich.

The winner of the prize in the prize game must personally collect the prize by presenting their identification card at the address of the Organizer. Alternatively, the prize may be sent via email or courier service to the address provided by the participant to the Organizer within 3 days from the date of receiving the email sent by the Organizer to the participant’s registered email address for contact and correspondence or from the date of receiving the written notification of winning the prize.

If the winner fails to collect the prize within the specified period or if the prize becomes unusable due to festival scheduling, they will forfeit the right to the prize.

The Organizer reserves the right not to award the prize if:

• The winner does not meet the requirements for prize collection.
• It is discovered that the participant in the prize game has violated the rules and conditions of the prize game.
• The winner provides incorrect delivery information.
• The winner does not provide an address within the territory of the Republic of Croatia.
• The winner fails to collect the prize within the deadline specified by the contracted partner for postal delivery.

Članak 7.

Cancellation, Interruption, or Suspension of the Prize Game

The prize game may be canceled, interrupted, or suspended only in the event of circumstances that the Organizer could not prevent, eliminate, or avoid. Participants will be informed about the cancellation, interruption, or suspension of the Prize Game on the official website of the Organizer (www.aircash.eu).

A canceled prize game cannot be repeated.

If the prize game is interrupted, it will be resumed under the same conditions, if feasible considering the specific circumstances of this prize game.

Unawarded prizes will be handled in accordance with legal regulations.

Article 8.

Termination of the Organizer’s Obligations

If the winner fails to meet the conditions for prize collection defined in these rules, refuses to accept the prize, or does not collect it within the deadline specified by the Organizer or the contracted partner for postal delivery, it means that the winner does not wish to receive the prize, and the Organizer is released from all obligations towards the winner. Consequently, the Organizer of the prize game has the right to dispose of the prize for other purposes. If the winner fails to provide their details within 24 hours of a subsequent call, the prize will not be awarded to them.

In any case, all obligations of the Organizer towards the prize winner cease at the moment when the winner or an authorized person designated by the winner personally collects the prize at the address of the Organizer or when the authorized courier service provider delivers the shipment to the winner’s address.

Article 9.

Collection and Processing of Data

By participating in the Prize Game, participants are aware of and consent to the collection, processing, and publication of their personal data provided by the participants themselves in the Prize Game (such as name, address, phone number, email address) for the purpose of conducting and carrying out this Prize Game and fulfilling all legal obligations, as well as delivering prizes in accordance with these Rules.

The data controller of personal data is the Organizer specified in Article 1 of these Rules.

Personal data of the participants in the Prize Game will be stored in accordance with the purpose of conducting the Prize Game and all legal obligations. The personal data of the winners may be shared with the postal service provider or courier service for the purpose of prize delivery.

The right to access data, rectification, erasure, and restriction of processing or data portability can be exercised by submitting a written request to the email address of the Organizer of the Prize Game [email protected]. A complaint regarding data processing can be filed with the Croatian Personal Data Protection Agency. The Organizer is authorized to disclose personal data of participants when necessary to comply with legal obligations.

Article 10.

Other Provisions

A participant who participates in the Prize Game accepts the rights and obligations stipulated in these Rules.

The Rules come into effect after approval by the Ministry of Finance and their publication on the official website of the Organizer (www.aircash.eu).

In the event of a dispute between the Organizer and participants of this Prize Game, the competent court is the Municipal Court in Zagreb.
