GUIDELINES FOR POLITICALLY EXPOSED PERSONS

According to the Anti-Money Laundering and Terrorist Financing Act (hereinafter referred to as the Law), which entered into force on 1 January 2018, Aircash is required to determine whether the beneficiaries are politically exposed persons when entering into a business relationship.

According to the Law, the definition of a politically exposed person is as follows:

Politically Exposed Person is any natural person who has acted or acted in a prominent public capacity in a Member State or a third country for the past 12 months, including members of his immediate family and persons known to be close associates of a politically exposed person.

Close family members are a spouse or a person with whom politically exposed person is in an extramarital union, children and their spouses or persons with whom the children of a politically exposed persons are in the extramarital union, and parents of a politically exposed person.

A close associate is any natural person known to have joint ownership of a legal person or entity or any other close business relationship with a politically exposed person or who is the sole beneficial owner of a legal entity or entity known to be established for the benefit of a politically exposed person.

Natural persons acting or were acting in a prominent public capacity are:

• President of the state
• Prime Minister
• Minister, Deputy Minister, Assistant Minister, Secretary of State
• Elected Member of the Legislature
• Member of the governing body of a political party
• Supreme or Constitutional Court judge or other judicial officer against whose decisions, except in exceptional cases, it is not possible to use legal remedies
• Judge of the Court of Auditors
• Member of the Central Bank Council
• Ambassador, Chargé d’Affaires
• High Armed Forces Officer
• Member of the management and supervisory boards of legal entities owned or majority owned by the state
• Director, Deputy Director, Board member and person performing equivalent functions in an international organization
• Municipal mayor, mayor and their deputy elected on the basis of the law governing local elections
